Regulation of cryptocurrency and virtual currency exchange
The legal environment of Estonia provides for businessmen the opportunity to legally provide services related to the exchange of cryptocurrencies, tokens and other crypto-assets and virtual values against a fiat currency for their customers and partners both directly in the office of their company and remotely around the world, using electronic channels of information, monetary funds, cryptocurrency and other virtual currencies.
- Virtual currency is a value presented in a digital form, that can be traded, stored and transferred, and which can be accepted as a means of payment by private persons and legal entities, but which is not a monetary or legal means of payment of any state. This means that a cryptocurrency and its derivatives, including tokens, fully fall within the definition of virtual value.
The legislation of the Republic of Estonia imposes on businessmen engaged in the exchange of cryptocurrencies against a fiat currency, the obligation to comply with measures to combat money laundering and terrorist financing (including AML/KYC procedures) and obtain a state license of provider of a service of exchanging a virtual currency against a fiat currency, or cryptocurrency license.
